Terms of Service for Myrddin Social Publisher
Effective: 31 July 2026
These Terms of Service govern the use of the Myrddin Social Publisher. The service helps authorised users prepare and translate their own editorial content and, following deliberate approval, transmit it to connected social-media accounts.
1. Operator and contact
The service is operated by Philipp Jürgen Weißgerber, artist name Myrddin Aquarius Gwais, Bärenweg 31A, 76149 Karlsruhe, Germany. Email: me@myrddin-gwais.de. Further provider information is available in the legal notice.
2. Scope of the service
The Social Publisher provides editorial tools for creating, editing, translating, scheduling and forwarding original content. Depending on the connections enabled, posts may be transmitted to services such as TikTok, Instagram, Facebook, Threads, Telegram or X. Publication only takes place after the respective destination has been expressly selected or approved. There is no entitlement to specific features, reach, publication times or permanent support for any third-party platform.
3. Authorised and acceptable use
Access is restricted to expressly authorised persons and lawful editorial purposes. Credentials and authorisations must not be disclosed to unauthorised third parties. Prohibited uses include unlawful, misleading, discriminatory, violent or otherwise harmful content, automated mass publishing, spam, manipulation of platform functions and circumvention of technical safeguards.
4. Responsibility for content and approval
Before approval, the publishing person must review the content, destination account, visibility, media, links, disclosures and platform options. That person is responsible for ensuring that publication is lawful and does not infringe third-party rights, including personality rights, copyright and related rights, trademarks, privacy law, advertising disclosures and youth protection. AI-assisted drafts and translations are suggestions and require editorial review before publication.
5. Intellectual property and licences
Rights in uploaded or created content remain with their respective owners. For technical processing and transmission, the user grants the operator the non-exclusive rights required for that limited purpose. The user confirms that all necessary rights and consents are available. Rights in the Social Publisher software, design and original documentation remain with the operator or the relevant licensors.
6. Third-party platforms
Publications are additionally governed by the terms, community guidelines and technical requirements of the destination platform. The operator does not control moderation, account restrictions, reach, format changes, API availability or subsequent processing by third-party platforms. Content may be rejected, displayed differently or removed by a platform. The Social Publisher must not be used to bypass platform rules or access restrictions.
7. TikTok connection and revocation
A TikTok connection is established only after express authorisation through TikTok. Before a Direct Post, the connected account, the privacy options permitted by TikTok, interaction settings and required disclosures are displayed or requested. Authorisation can be revoked at any time through the security or app settings of the TikTok account. Deletion of the TikTok connection stored by the Social Publisher may also be requested by emailing me@myrddin-gwais.de. No new posts will be published through the connection once revocation becomes effective.
8. Privacy and security
Information about personal-data processing, connected services and data-subject rights is provided in the Privacy Policy. Users must protect their credentials and promptly report suspected misuse.
9. Availability and service changes
The service is operated with reasonable care but may be temporarily restricted because of maintenance, security measures, technical faults or changes to external APIs. Features may be changed or discontinued where required for technical, legal or security reasons. Scheduled publications must be reviewed following relevant changes.
10. Liability
The operator has unlimited liability for intent and gross negligence, injury to life, body or health, and mandatory statutory liability. For a slightly negligent breach of an essential obligation, liability is limited to the foreseeable and typically occurring loss. Liability for other cases of slight negligence is excluded. The operator is not liable for decisions, restrictions, outages or display changes by external platforms or for content approved without adequate user review.
11. Suspension and termination
Access may be suspended or terminated in cases of misuse, security risk, unlawful conduct or breach of these Terms. Users may stop using the service and revoke connected platform authorisations at any time. Mandatory retention duties and the preservation of necessary evidence remain unaffected.
12. Changes to these Terms
These Terms may be updated when features, platform requirements or applicable law change. The current version and effective date are published on this page. Material changes will be identified appropriately. Mandatory statutory rules take precedence.
13. Governing law
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection rules of a consumer’s country of habitual residence remain unaffected. If a provision is invalid, the applicable statutory provision takes its place and the remaining provisions remain unaffected.
